Florida Underground Services, L.L.C., doing business as MTI Equipment (“MTI Equipment”, “we”, “us” or “our”), operates the website at www.mtiequip.com and the sales, service, enquiry and communication channels described below. This Privacy Policy explains what personal information we collect, how we use it, who we disclose it to, how long we keep it, and the choices available to you.

This Privacy Policy applies to www.mtiequip.com, to our web chat, telephone, email and text messaging channels, and to information we collect on printed forms, service orders and at trade shows. Section 4 deals specifically with our text messaging program and should be read carefully by anyone who has given, or is considering giving, consent to receive text messages from us.

This Privacy Policy is a notice. It does not form part of, vary, or limit any written quotation, purchase agreement, warranty document, service order or credit agreement between you and MTI Equipment. Our website Terms and Conditions, available at www.mtiequip.com/terms-conditions/, govern your use of the website and of our text messaging program.

1. Who We Are

The business responsible for the personal information described in this Privacy Policy is:

1.2 What we do

MTI Equipment buys, refurbishes, sells, services and supports horizontal directional drilling (HDD) equipment, drilling support equipment, trailers, tooling and related parts for utility and underground construction contractors.

1.3 How the website is used

www.mtiequip.com publishes equipment inventory and receives enquiries. We do not sell equipment, take orders, or accept payment through the website. Purchases are concluded separately in writing following an enquiry made by web form, web chat, email or telephone.

1.4 Who this Privacy Policy is directed to

Our website and services are directed to businesses and business representatives in the United States, and are intended for individuals aged 18 or over. See Section 11 and Section 13.

2. Information We Collect

2.1 Information you provide to us

We collect the information you voluntarily submit when you request a quotation, enquire about equipment, offer equipment for sale or trade, subscribe to communications, ask about financing, schedule service, order parts, or otherwise contact us. This may include:

  • Your name
  • Your company or business name and your role
  • Email address
  • Mobile, business and other telephone numbers, including the specific number you authorise us to contact
  • Mailing, billing, delivery and job site addresses
  • Equipment interests, job requirements, specifications and project details
  • Trade-in details and information about equipment you currently own, including serial numbers, hour meter readings and condition
  • Messages, enquiries, web chat transcripts and correspondence you send us
  • Records of your consent to receive communications, including the date, time, method and source of that consent, the telephone number or email address to which the consent relates, and the exact wording and version of the disclosure you were shown

2.2 Information collected automatically

When you visit www.mtiequip.com, we and our analytics and advertising providers may automatically collect:

  • IP address and the general geographic area it indicates
  • Browser type, device type and operating system
  • Pages viewed, time on page, and referring and exit pages
  • Date and time of access
  • Information collected through cookies, pixels and similar technologies, as described in Section 7

2.3 Information from third parties

We may receive information about you from equipment marketplaces and listing platforms, referral partners, trade show organizers, financing partners, and publicly available business sources. Any such information is handled under this Privacy Policy.

2.3.1 Limits on third-party sourced numbers

We do not purchase, rent, lease, license or otherwise acquire telephone numbers from list vendors, lead brokers, data brokers or scraped or harvested sources for the purpose of sending text messages. We send text messages only to numbers for which we hold a record of consent obtained in one of the ways described in Section 4.2.

2.4 Information we do not collect through the website

We do not knowingly collect government identification numbers, financial account numbers, precise geolocation, biometric information, health information, or information about racial or ethnic origin, religious beliefs, sexual orientation or trade union membership through www.mtiequip.com.

2.4.1 Financing referenced on our website is provided by third-party lenders. Applications are submitted to and assessed by the lender under the lender’s own privacy notice and terms. Where we assist you with a referral, we collect only the contact, business and equipment information needed to make that referral, and we do not request or retain credit report data or lender credit decision data.

3. How We Use Your Information

We use the information we collect to:

  • Respond to your enquiries, quotation requests, trade or sale offers, and service requests
  • Provide equipment information, pricing, availability, inspection and delivery details
  • Process and support transactions, service work and parts orders
  • Send transactional and service-related communications
  • Send marketing communications about equipment, inventory, events and promotions, where you have consented or where the law otherwise permits
  • Verify and document your consent to receive text messages and marketing email, including the wording shown to you, the date and time, the method, and the originating page or form
  • Maintain suppression lists and honor opt-out and withdrawal requests across our systems
  • Improve our website, our inventory presentation and our customer experience
  • Detect and prevent fraud, abuse and security incidents
  • Establish, exercise or defend legal claims
  • Comply with legal, regulatory, carrier and contractual obligations, including those applicable to our text messaging program

We do not use your personal information to make automated decisions that produce legal or similarly significant effects about you.

4. SMS and Text Messaging Program

This Section describes how our text messaging program operates and how we handle information relating to it. It should be read together with Section 3 of our Terms and Conditions at www.mtiequip.com/terms-conditions/.

4.1 Program identity

Program name: MTI Equipment Customer Messaging. Messages are sent from +1 941-474-6789. Our identity is disclosed in our messages and the originating number is not concealed or substituted.

4.2 Consent

We send text messages only to individuals who have given prior express written consent to receive them. Consent may be given by:

  • Checking an SMS consent box on a form at www.mtiequip.com. The box is never pre-checked and is never required in order to submit the form
  • Sending a keyword by text message to a published MTI Equipment business number
  • Signing, or checking a consent box on, a printed form, service order, quotation or trade show sign-up sheet

4.2.1 Verbal statements

If you tell one of our representatives verbally that you would like to receive text messages, we will not add you to the program on the basis of that verbal statement alone. We will ask you to complete the consent box on www.mtiequip.com or on a printed form, or we will send you a written confirmation request by email, and we will add you to the program only once we hold that written record.

4.2.2 Contents of the consent record Each consent record we retain includes the telephone number you authorized us to contact, the date and time of consent, the method and source of consent, and the exact wording and version of the disclosure presented to you at the time.

4.2.3 Consent is never a condition Consent to receive text messages is not a condition of purchase, financing, service, inspection, delivery, or any other transaction with MTI Equipment. Declining or withdrawing consent will not affect the price, availability or terms of anything we sell or service.

4.3 Messages you may receive

Transactional and service messages, sent in connection with an active enquiry, order, service job or account:

  • Replies and follow-up regarding quotation and enquiry requests
  • Appointment, inspection, demonstration and delivery confirmations and reminders
  • Service and parts order status updates
  • Customer support and account-related messages

Marketing messages, sent only where you have consented to receive them:

  • Equipment availability, new inventory and pricing updates
  • Promotional messages about equipment, offers and events

4.4 Message frequency

Message frequency varies according to your interactions with us and the programs you have joined. We expect to send no more than 4 marketing messages per month. Transactional and service messages are sent as required by the matter they relate to.

4.5 Message and data rates

Message and data rates may apply, both to messages we send to you and to messages you send to us. Contact your wireless provider for details of your plan.

4.6 Withdrawing consent and opting out

You may withdraw your consent at any time, and you may do so by any reasonable means. Replying with any of the following words to a message you receive from us will always be treated as a withdrawal of consent: STOP, END, QUIT, CANCEL, UNSUBSCRIBE, REVOKE, OPT OUT.

We will also honor a withdrawal of consent communicated in any other reasonable way, including by telephone to 941-474-6789 or 1-844-684-3784, by email to [email protected], by reply text using other wording that reasonably communicates that you no longer wish to receive messages, or in writing to our mailing address in Section 1.

After you withdraw consent we will send a single confirmation message, and no further messages will be sent unless you opt in again. We process withdrawals as soon as practicable and in no case later than ten business days after receipt, and we apply them across our messaging platform and our customer relationship management system.

4.7 When and how often we send messages

We do not send marketing text messages before 8:00 a.m. or after 9:00 p.m. in the recipient’s local time zone. We do not send more than three marketing text messages concerning the same subject to the same recipient in any 24 hour period.

4.8 No sale or sharing of mobile opt-in data

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information sharing with subcontractors in support services, such as customer service providers and messaging platform vendors, is permitted. All other categories of information sharing exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

We do not sell, rent, lease or trade your mobile telephone number or your SMS consent data to any third party under any circumstances. Your mobile telephone number and SMS consent data are not disclosed to our analytics or advertising providers, are not used for targeted or interest-based advertising and are not used for lead generation.

4.9 Retention of consent and opt-out records

We maintain records of SMS consent and of withdrawal or opt-out requests for at least five years from the date the consent was given or withdrawn, whichever is later, and for longer where needed to demonstrate compliance with applicable law and carrier requirements or to defend a claim. Withdrawal requests are honored across all of our messaging systems and are not deleted from our suppression list.

4.10 Carrier matters

Mobile carriers are not liable for delayed or undelivered messages. Carriers may filter, delay or block messages, and we are not responsible for the consequences of carrier filtering or blocking.

4.11 Florida recipients

We are located in Florida and many of our customers hold Florida telephone numbers. Our text messaging program is operated to comply with the Florida Telephone Solicitation Act, section 501.059 of the Florida Statutes, in addition to the federal Telephone Consumer Protection Act and the rules of the Federal Communications Commission. If you have asked us to stop sending marketing text messages and you continue to receive them, please tell us immediately at 941-474-6789 or [email protected] so that we can correct the problem.

5. Email Communications

5.1 If you provide your email address, you may receive transactional email relating to your enquiries, orders and service, and, where you have consented, marketing email from MTI Equipment.

5.2 Every marketing email we send includes a working unsubscribe link and our postal address. You may also unsubscribe by contacting us using the details in Section 1. We honor unsubscribe requests promptly and in no case later than ten business days after receipt.

5.3 Unsubscribing from marketing email does not stop transactional email relating to an active enquiry, quotation, order, service job or account.

6. How We Share Information

6.1 We do not sell your personal information for money. We disclose personal information only as set out in this Section and in Section 7.

6.2 Service providers and subcontractors

We disclose information to vendors who perform services on our behalf, including website hosting, customer relationship management and marketing platforms, messaging and email delivery providers, analytics providers, payment processors, transportation and logistics providers, and customer support tools. These providers are contractually limited to using the information solely to provide services to us.

6.3 Manufacturers, financing partners and service partners

At your request or with your authorization, we may disclose the information necessary to progress a financing referral or application, a warranty claim, a parts order, or a service request.

6.4 Business transfers

If MTI Equipment is involved in a merger, acquisition, financing or sale of assets, information may be transferred as part of that transaction, subject to this Privacy Policy.

6.5 Legal requirements and protection of rights

We may disclose information required by law, subpoena, court order or governmental request, or where we reasonably believe disclosure is necessary to protect our rights, safety or property, or those of others.

6.6 Advertising and analytics technologies

As explained in Section 7, we use third-party analytics and advertising technologies on www.mtiequip.com. These technologies may disclose online identifiers, device information and browsing activity to the providers concerned for measurement and advertising purposes. Under some state privacy laws, a disclosure of that kind is treated as a “sale” or as “sharing” for cross-context behavioral advertising, even where no money changes hands. Section 7 explains how to opt out.

6.7 Mobile data excluded from all sharing

As stated in Section 4.8, mobile telephone numbers collected for text messaging and all associated SMS consent data are excluded from every sharing category in this Section, except for delivery to our messaging service providers for the sole purpose of transmitting the messages you asked to receive. This data is never disclosed to third parties or affiliates for marketing, promotional, lead generation, advertising or third-party analytics purposes.

7. Cookies, Analytics and Advertising

7.1 We use cookies, pixels and similar technologies to operate www.mtiequip.com, remember your preferences, measure site performance, and support advertising. The categories we use are:

  • Strictly necessary cookies, which are required for the site to function and to remember your cookie choices
  • Analytics cookies, which help us understand how the site is used. We use Google Analytics for this purpose
  • Advertising cookies and pixels, which measure the performance of our advertising and help us reach people who may be interested in our equipment. We use the Meta Pixel for this purpose

7.2 How to control cookies You can manage analytics and advertising cookies using the cookie settings control on www.mtiequip.com, and you can block or delete cookies through your browser settings. Disabling cookies may affect how parts of the site function. You may also use the opt-out and advertising preference controls offered by the providers themselves.

7.3 Opt-out preference signals We do not currently represent that our website automatically detects browser-based opt-out preference signals such as Global Privacy Control. To opt out of analytics and advertising cookies, please use the cookie settings control on www.mtiequip.com, your browser controls, or contact us using the details in Section 1 and we will action your request.

7.4 Limits We do not disclose your mobile telephone number, your SMS consent data, or the content of your enquiries to our analytics or advertising providers, and we do not use these technologies to build profiles of individuals we know to be under 18.

8. Data Retention

8.1 We retain personal information for as long as necessary to fulfil the purposes described in this Privacy Policy, to maintain our business and transaction records, to resolve disputes, and to comply with legal and tax obligations.

8.2 Consent and opt-out records are retained as described in Section 4.9. Suppression list entries are retained indefinitely so that we do not contact a person who has asked us to stop.

8.3 Where information is no longer needed for any of these purposes, we delete it or de-identify it.

9. Data Security

9.1 We maintain administrative, technical and physical safeguards designed to protect personal information against unauthorized access, disclosure, alteration and destruction. Access to consent records and customer data is limited to personnel who need it to perform their role.

9.2 No method of transmission or storage is completely secure, and we cannot guarantee absolute security. We do not claim any specific security certification or third-party security attestation.

9.3 If a security incident affecting personal information occurs, we will notify affected individuals and the relevant authorities where required to do so, including under the Florida Information Protection Act, section 501.171 of the Florida Statutes.

10. Your Rights and Choices

10.1 Choices available to everyone

Whatever your location, you may:

  • Withdraw consent to text messages at any time, as described in Section 4.6
  • Unsubscribe from marketing email at any time, as described in Section 5.2
  • Manage analytics and advertising cookies, as described in Section 7.2
  • Ask us to correct information we hold about you

10.2 Rights under state privacy laws

Depending on where you live, you may also have the right to request access to the personal information we hold about you, to request correction of inaccurate information, to request deletion of your personal information, to obtain a portable copy of it, to opt out of targeted advertising and of any sale or sharing of personal information, to appeal a decision we make on a request, and not to be discriminated against for exercising any of these rights.

10.3 How to exercise your rights

We may need to verify your identity before acting on a request, and we may ask for information sufficient to allow us to locate your records. We will respond within the period required by the law that applies to you, and in any event within 45 days of receiving a verifiable request, unless an extension is permitted and we notify you of it. An authorized agent may submit a request on your behalf with written authorization that we can verify.

10.4 Business contact information

Much of the information we hold relates to individuals acting in a business capacity. State privacy laws differ on whether business contact information is covered. We will handle a verifiable request on the same basis whether the information was given to us in a personal or a business capacity.

10.5 California residents

If you are a California resident, the California Consumer Privacy Act as amended by the California Privacy Rights Act may give you the rights described in Section 10.2. We do not sell personal information for monetary consideration and we do not use or disclose sensitive personal information for the purpose of inferring characteristics about you. As explained in Sections 6.6 and 7, our use of advertising technologies may constitute “sharing” for cross-context behavioral advertising, and you may opt out at any time using the cookie settings control on www.mtiequip.com or by contacting us. We do not have actual knowledge that we sell or share the personal information of consumers under 16 years of age. We will not discriminate against you for exercising any of these rights.

11. Children's Privacy

Our website and services are intended for business use by adults aged 18 or over. We do not knowingly collect personal information from anyone under 18, and we do not knowingly send text messages to anyone under 18. If we learn that we have collected such information, we will delete it and remove the number from our messaging systems. 12. Third-Party Links and Services

Our website may link to third-party sites and services, including manufacturer sites, financing partners, equipment marketplaces, mapping services and social media platforms. We do not control and are not responsible for the privacy practices or content of those sites and services. Review their privacy notices before providing information to them.

13. Visitors Outside the United States

MTI Equipment operates in the United States and our website and services are directed to users in the United States. Information we collect is stored and processed in the United States. If you access our website from outside the United States, you do so on the understanding that your information will be handled as described in this Privacy Policy. We do not offer our text messaging program to numbers outside the United States.

14. Changes to This Privacy Policy

14.1 We may update this Privacy Policy from time to time. The Effective Date and Version above reflect the current revision, and material changes will be posted on this page.

14.2 We will not use mobile telephone numbers or SMS consent data collected under an earlier version of this Privacy Policy for a materially different purpose without obtaining fresh consent for that purpose.
